Record of Decisions

 

This document is a preliminary working paper for the use of the Governing Body and officials of the Office. It records only the Governing Body's decisions, and not the circumstances of their adoption, except where they were the result of a formal vote. The comments or reservations by individual members or groups subject to which the decisions were made will be found in the minutes of the session.

Where an Office publication or paper refers to a Governing Body decision, the source given should be the relevant Governing Body document and minutes, and not this Record of Decisions.

The Record of Decisions is arranged in the order of the items on the Governing Body's agenda. All decisions relating to a particular paper or section of a paper are grouped together. After the decision the sitting at which it was taken is indicated in brackets together with the basis on which it was taken, including appropriate references to Governing Body papers. The decisions are reproduced in full, with the exception of those relating to reports of the Committee on Freedom of Association, where a simple reference is made to the paragraphs of the report which form the basis of the decision.

The table of contents is in the form of a detailed agenda showing for each item the number of the relevant Governing Body paper and that of the relevant paragraph in the Record of Decisions.

2. The Governing Body requested law and practice reports or more detailed proposals on the following subjects to be submitted to it at its 277th Session (March 2000):

  1. New measures concerning discrimination in employment and occupation -- Extension of the grounds on which discrimination is prohibited in Article 1 of Convention No. 111.
  2. Employment of women.
  3. The informal sector.
  4. Investment and employment.
  5. Migrant workers.
  6. Recording and notification of occupational accidents and diseases (adjusted to take account of the Governing Body's discussions).

6. The Governing Body requested the Director-General --

  1. to draw the attention of the governments of member States of the Americas and, through them, that of their national employers' and workers' organizations, to the Conclusions adopted by the Meeting;
  2. to bear the Conclusions in mind in executing ongoing programmes and in preparing future Programme and Budget proposals;
  3. to transmit the text of the Conclusions --
    1. to the governments of all member States and, through them, to national employers' and workers' organizations;
    2. to the international organizations concerned, including the non-governmental international organizations having consultative status.

of the International Labour Organization, to secure compliance
by the Government of Myanmar with the recommendations of the
Commission of Inquiry established to examine the observance of the
Forced Labour Convention, 1930 (No. 29)

8. The Governing Body invited the Director-General --

  1. to ensure that no technical cooperation or assistance to the Government of Myanmar, except for the purpose of direct assistance to implement immediately the recommendations of the Commission of Inquiry, was considered or undertaken by the Office; and
  2. to take the necessary steps to ensure that no proposal to invite or invitation to attend meetings, symposia or seminars organized by the ILO was extended to the Government of Myanmar, except for meetings that have the sole purpose of securing immediate and full compliance with the Commission of Inquiry's recommendations;

for so long as the Governing Body, or its Officers acting on its behalf, had not noted the implementation of the Commission of Inquiry's recommendations.

9. The Governing Body decided, in accordance with article 10, paragraph 1 of its Standing Orders, to take a decision at its 277th Session (March 2000) on whether to place on the agenda of the 88th Session of the Conference (June 2000) an item entitled: "Action recommended by the Governing Body under article 33 of the Constitution -- Implementation of the recommendations contained in the report of the Commission of Inquiry Forced Labour in Myanmar (Burma)". (Second sitting; GB.276/6, para. 17)

10. The Governing Body requested the Office to submit to it, at its 277th Session (March 2000), a paper detailing the various options, taking account of the views put forward during the preliminary examination of the question, in order to enable it at that session to adopt recommendations under article 33 of the Constitution, should it decide to do so. 11. The Governing Body invited the Director-General to inform the members of the Governing Body, by means of an update to his written report dated 21 May 1999, to be communicated to them by 28 February 2000 at the latest, of the measures taken by the Government of Myanmar to give effect to the recommendations of the Commission of Inquiry, taking into account in its preparation all the comments made by the Government of Myanmar, the information provided by the employers' and workers' organizations, and all other reliable sources.   2. decided that it would take a decision on the advisability of appointing a Commission of Inquiry in June 2000, when it would take into account the elements provided by a direct contacts mission and by the Committee on Freedom of Association in making its decision on whether to appoint a commission of inquiry or not.

22. The Governing Body rescinded the decision taken at its 274th Session (March 1999) concerning financing arrangements and decided that, should it decide to establish a Commission of Inquiry concerning Colombia -- (1) 

  1. an honorarium at the rate of $300 per day be paid to each member of the Commission of Inquiry;
  2. the cost of the Commission in 2000-01, estimated at $528,000, be financed in the first instance from savings in Part I of the budget on the understanding that, should it subsequently prove impossible, the Director-General would propose alternative methods of financing at a later stage in the biennium.

The Governing Body renewed the appointments of Mr. Yves Oltramare, Baron Sirtema van Grovestins and Mr. Jean Pierre Cuoni as members of the Investments Committee of the International Labour Organization for a further period of three years, expiring on 31 December 2002. 28. The Governing Body --

  1. accepted the recommendations of the ICSC, subject to their approval by the United Nations General Assembly, concerning an increase of 3.42 per cent in the base/floor salary scale, and consequential increases in the mobility and hardship allowance and separation payments, for staff in the Professional and higher categories, with effect from 1 March 2000;
  2. authorized the Director-General to give effect in the ILO, through amendments to the Staff Regulations as necessary, to the measures referred to in subparagraph (a), subject to their approval by the General Assembly.

Appendix

Ad hoc arrangements for the discussion of the global report
under the follow-up to the Declaration at the
88th Session of the International Labour Conference

Principle of the discussion

Having regard to the various options referred to in the Annex to the Declaration, the Governing Body recommends that the global report submitted to the Conference by the Director-General should be dealt with separately from the Director-General's reports under article 12 of the Conference Standing Orders and should be discussed during plenary sittings devoted entirely to it.

Timing of the discussion

Two sittings on the same day should be convened for the discussion of the global report, with the possibility, if necessary, of extending the sitting or convening a further sitting on the same day or on a different day, as appropriate.

In order to take account of the programme of work of the Conference and of the fact that a number of ministers who usually are present during the second week of the Conference may wish to take the floor, the discussion of the global report should be held during the second week of the Conference.

Procedure for the discussion

The separate discussion of the global report recommended above implies in particular that the statements made during the discussion of the global report should not fall under the limitation concerning the number of statements by each speaker in plenary provided for in article 12, paragraph 3, of the Standing Orders, and that the discussion should not be governed by the provisions of article 14, paragraph 6, concerning the time limit for speeches. These provisions should accordingly be suspended under the procedure provided for in article 76 of the Standing Orders to the extent necessary for the discussion of the global report.

Organization of the discussion

Special arrangements will be made by the Officers of the Conference for the organization of the discussion.

The time available would be divided into three phases: a first phase devoted to opening statements by the spokespersons of the Employers and Workers and, if appropriate, by other delegates; a second phase for statements by individual delegates; and a third phase to allow spokespersons of the groups and other delegates to make their concluding remarks in the discussion.

The speaking time would be set, subject to adjustments decided by the Officers of the Conference, at ten minutes for speeches by group spokespersons and at five minutes for delegates' speeches.
